Terms of Service

These terms are an agreement between you and Axerity ("we", "us"). By using axerity.com, our docs, AxAgent, the AxAgent API, or the SDK (the "services"), you agree to them. If you use the services for a company, you agree on behalf of that company and confirm you are allowed to.

AxAgent is a private AI agent with its own computer. It launches in Q4 2026. Before then, access may be limited to early access users, and features, limits, and APIs may change. We may add, change, or remove features over time, and will give notice of significant changes.

• Give us accurate information and keep it up to date.
• Keep your password and API keys secret.
• You are responsible for everything that happens under your account and your API keys. Tell us right away if you think they have been misused.
• You must be at least 16 years old to use the services.

You own what you put into the services and what your agent produces for you. You give us permission to store, process, and transmit it only as needed to run the services for you.

We never train AI models on your content. See our Privacy Policy for how we handle data.

AxAgent acts on your instructions. It can run code, install software, call tools, and open ports at public addresses. You are responsible for the tasks you give it and for what it does on your behalf.

AI can make mistakes. Review important work before you rely on it, and use tool approvals for actions that need a human to confirm them.

Do not use the services to:

• Break the law or help someone else break it.
• Create, store, or send malware, phishing pages, spam, or content that exploits children.
• Attack, scan, or disrupt other systems, or get around security controls.
• Infringe other people's rights, including their privacy.
• Mine cryptocurrency, or resell compute in ways we have not agreed to.
• Get around usage limits, or access the services in ways other than the ones we provide.

When you use a hosted model, you also need to follow that model provider's usage policies.

If you build agents for your own customers, you are responsible for your customers' use, for your own terms and privacy notices, and for having the right to send us their data.

The services work with third-party services, such as model providers, Discord, and Signal. Your use of those services is covered by their own terms. If you bring your own model key, your agreement with that provider applies to those requests.

• Prices are listed on our pricing page. Usage is billed as you use it.
• Prices do not include taxes, which you are responsible for.
• We may change prices. We will tell you at least 30 days before a change applies to you.
• Fees are non-refundable, except where the law says otherwise. If a payment fails, we may limit or suspend your account until it is paid.

Our open-source projects, such as Trex and Pulse, are covered by the licenses in their repositories, not by these terms.

You can stop using the services and close your account at any time.

We may suspend or close your account if you break these terms, if your use puts the services or other users at risk, or if the law requires it. Where we can, we will warn you first and give you a chance to export your data.

The services are provided "as is" and "as available". AI output can be wrong, incomplete, or out of date. To the extent the law allows, we do not make any warranties, including that the services will be uninterrupted or error-free, or fit for a particular purpose.

To the extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, data, or revenue. Our total liability for any claim about the services is limited to the greater of what you paid us in the 12 months before the claim, or 100 US dollars.

If someone makes a claim against us because of your content, your use of the services, or your breach of these terms, you agree to cover the reasonable costs of that claim.

We may update these terms. We will post the new version here and update the effective date. If a change is significant, we will tell you by email before it takes effect. If you keep using the services after that, you accept the new terms.

These terms are governed by the laws of the place where Axerity is established, without regard to conflict of law rules. If any part of these terms cannot be enforced, the rest still applies.
